The National Archives told the committee that while it can't complete its review of approximately 900,000 pages of documents related to Kavanaugh until late October, it can review some 300,000 pages of "textual records" from 49,000 emails from Kavanaugh while he served in the White House Counsel Office by August 20.

The GOP statement said the committee was counting on receiving documents "in an even more rapid fashion" from the archives of the George W. Bush Presidential Library. Republicans downplayed the National Archives' announcement, in part because of the separate ongoing Bush review, with a spokesman for Senate Judiciary Chairman Chuck Grassley signaling the committee still plans to hold confirmation hearings in September.

Senate Democratic Leader Chuck Schumer said Democrats also object to the Bush library, rather than nonpartisan archives officials, vetting the documents. Those documents now need to be reviewed by relevant stakeholders before being submitted to the committee, he said.


Noting the Bush Library "will produce to us over 125,000 pages today", Foy said "I expect the committee will be able to undertake its thorough review process along the same timeline set in previous Supreme Court confirmations". As Chairman Grassley said this morning, he intends to hold a hearing sometime in September.

"As I've continued to say, one of the most important jobs of any US senator is to fully vet any nominee to serve on the Supreme Court, the highest court in our land", Heitkamp said in a statement.

A delay in the confirmation process would give Democrats more time to hammer Kavanaugh, a conservative jurist they fear could swing the high court to the right for decades and imperil landmark cases like Roe v. Wade.

"Your unduly restrictive reading of the law results in one political party having complete control over what records the Senate will be able to see", she wrote, adding that "a biased denial of document requests to one half of the Committee is unsupported by the law".

Stern wrote that the the archives had reviewed 70,000 records for the confirmation process for Chief Justice John G. Roberts Jr., and 170,000 records for the confirmation process for Justice Elena Kagan. They cover Kavanaugh's time in the White House counsel office and his nomination to be a judge. Committee Democrats did not sign on to the letter, and then sent their own request July 31 asking for records for Kavanaugh's work as staff secretary.
