In the 16-page filing, attorneys for DefDist hold that Grewal and Feuer "have waged an ideologically-fueled program of intimidation and harassment against" the company, intending to drag Wilson "before all manner of far-flung criminal and civil tribunals in an effort to silence the organization".

The complaint alleges the public availability of the gun plans pose a "serious threat to the national security and public safety" of citizens. Defense Distributed is claiming that threatening a lawsuit to try to prevent the releasing of the files violates their Constitutionally protected speech, the Dormant Commerce Clause, the Right to Bear Arms, and the Supremacy Clause. "All actions contemplated by Defense Distributed are fully protected by the First Amendment, and [Grewal's] attempts to prevent such actions constitute an unconstitutional prior restraint and otherwise violate the United States Constitution and the New Jersey Constitution". But due to the pending legal battle, Wilson has made a decision to abide by the cease-and-desist orders, and will not make DEFCAD available in Pennsylvania, New Jersey, and Los Angeles.

The issue first surfaced in 2013 when the State Department went after Wilson, arguing that making the computer programming available globally via the internet put him afoul of USA laws on gun exports.

Defense Distributed began sharing some of the files Friday.

The federal government had been fighting the case since 2015, when Defense Distributed founder Cody Wilson, a self-described anarchist, sued the State Department over a 2013 order demanding that he take down blueprints for "the Liberator", a single-shot.380 caliber handgun made nearly entirely of 3D-printed plastic.
