Case Against Missouri Gov. Eric Greitens Can Proceed, Judge Rules
Trial still on: Judge does not dismiss charge against Greitens

Greitens was indicted in February on a charge of invasion of privacy.
Greitens is charged with a felony for allegedly taking a photo of a naked woman without her consent. Greitens has admitted to the affair with his St. Louis hairdresser but denied criminal wrongdoing and has called St. Louis Circuit Attorney Kim Gardner a "reckless liberal prosecutor".
Attorneys for Greitens say a private investigator hired by the prosecutor has repeatedly lied to the court.
A judge in St. Louis should rule Thursday whether a criminal case against Missouri Governor Eric Greitens should proceed or not.
Gardner spokeswoman Susan Ryan said that even in cases that are not high-profile, defense attorneys use a similar strategy.
Attorneys for Greitens have said prosecutors withheld a videotaped deposition with the woman until an hour before a special state House committee released a report last week that cited allegations of unwanted sexual aggression against the woman, and been slow to turn over other evidence. Burlison decided defense attorneys also will be allowed to retake depositions from the woman herself and Tisaby, but defense attorneys will only be able to ask about information they thought was missing when Gardner withheld the tape or that they believe to be conflicting.
"These rules are not mere rules of etiquette", Burlison said. "Clearly in this case the state has committed sanctionable discovery violations of the rules of criminal procedure".
Attorneys for Greitens contend that a private investigator hired by the prosecutor has repeatedly lied to the court.
The woman with whom he had the affair has described Greitens taking a photo of her while she was bound, nude and blindfolded, and then threatening to blackmail her with the photo if she told anyone about their relationship.
The trial is scheduled for May 14. It's among many worries for the Republican governor. Several lawmakers, including Republicans, have called for his resignation since the House committee's report.
If Greitens doesn't quit, Senate President Pro Tem Ron Richard said the House should immediately begin impeachment proceedings to try to remove him from office.
The panel is still investigating separate claims that Greitens took a donor list without permission from a veterans' charity and used it for his gubernatorial campaign. St. Louis University Political Science Professor Dr. Ken Warren points to the Missouri constitution that states any elected official is "liable to impeachment for crimes, misconduct, habitual drunkeness, willful neglect of duty, corruption in office, incompetency, or any offense involving moral turpitude or oppression in office".
That motion relates to potential new felony charges, which the attorney general says there's enough evidence to bring against the governor over his campaign practices.
