The repeal of the net neutrality rules was a victory for internet service providers such as AT&T, Comcast and Verizon, conferring power over what content consumers can access.

On Thursday, the American Library Association - which is among the groups that have long supported net neutrality - declared that open Internet principles are "essential" to intellectual freedom and democracy. By our count, 114 representatives have made public commitments in support of voting for a CRA action. However, the chances of preserving net neutrality via the Congressional Review Act seem slim. Congress has exclusive authority to regulate interstate commerce, which is the basis of the FCC's legal argument.

So far, governors in Hawaii, Montana, New Jersey, New York and Vermont have taken final action by signing executive orders, Free Press notes. Many mayors voiced opposition to an overturning of the 2015 rules, too.

Software company Mozilla announced on its blog Thursday morning that it had re-filed its suit.

A court victory is likely the best chance the FCC's opponents have to thwart the agency.

Whether the states can be legally successful with their challenges remains to be seen, says Brent Skorup, a senior research fellow at the Mercatus Center at George Mason University. Governors of several states - New Jersey, Montana and NY - have already signed executive orders that effectively establish net neutrality principles at the state level.

As it now stands net neutrality ensures that internet providers won't be able to block or limit access to content by offering paid workarounds.

The Republican-led FCC voted along party lines in December to repeal Obama-era net neutrality protections, which were meant to keep the internet open and fair.
