The man suspected of causing the collision Sunday has twice been deported from the US, and had a 2005 conviction for driving under the influence in California, authorities said.

He is now in the Marion County, Indiana jail awaiting charges.

Indianapolis Colts player Edwin Jackson and his Uber driver were killed on February 4, 2018, by a motorist believed to be driving drunk.

President Donald Trump said it was "disgraceful" that an Indianapolis Colts linebacker was killed in a suspected drunken-driving crash by a person who was in the USA illegally.

Orrego-Savala gave police a fake name when he was arrested and also had a blood alcohol level of 0.239, which three times the legal limit in the state of Indiana.

Orrego-Savala was arrested after trying to flee the scene on foot, according to police, who also said he was intoxicated.

Investigators said they believe Orrego-Savala was intoxicated at the time of the IN crash.

Orrego-Savala's only responses in court were answering through an interpreter as the judge explained the proceedings and charges.

The immigration charges will remain pending until the state case is concluded, federal prosecutors say.

Prosecutors filed a motion seeking a DNA sample from Orrego-Savala, arguing it could help determine whether he was in the truck that hit Jackson and Monroe.

Investigators say the suspect, 37-year-old Manuel Orrego-Savala, has twice been deported from the US and was illegally living in the country at the time of Sunday's crash in Indianapolis.

Aside from Orrego-Savala's two prior deportations, he was convicted in 2005 for driving under the influence in Redwood City, Calif., ICE reports. "Much of such commentary, including tweets by the president, fails to acknowledge that both Edwin Jackson and Jeffrey Monroe lost their lives on Sunday".

Orrego-Savala, and was again living illegally in the U.S.at the time of the crash, according to investigators. "This is just one of many such preventable tragedies".

It took a few days but Donald Trump eventually got around to speaking on the subject, and while he sent out his condolences, he also used the opportunity to push his agenda on illegal immigration, because the drunk driver wasn't supposed to be in this country. Manuel Orrego-Savala, 37, killed the 26-year-old Jackson and his 54-year-old driver, Jeffrey Monroe, on Interstate 70 on Sunday while reportedly driving drunk.

"The family is in shock, as you can imagine".

It remains unclear exactly when Orrego-Savala returned to the USA after his last deportation. He has additional criminal convictions in California and Indiana. "It's a tragedy. It's a police investigation story", said Clare Corado, who leads the IN immigration law unit.
